Transition and Renewal Regulations for Original Health Food Approval Documents After the New Policy

1. Transition of Products Whose Health Functions Have Been Included in the “Function Catalog · Non-nutrient Supplements (2023 Edition)”

      For products whose health functions have been included in the “Function Catalog · Non-nutrient Supplements (2023 Edition)”, a 5-year transition period will be set from the date of this announcement to standardize the health function claims of registered and filed products. The corresponding functions of the published “Health Food Ingredients Catalog” are adjusted according to the “Function Catalog · Non-nutrient Supplements (2023 Edition)”, and the “Requirements for Correspondence Between New and Old Health Function Claims and Convergence of Function Evaluation” have been formulated.

      Among them, for filed products, the filer applies to the original filing agency to change the name of the health function. For products that have been approved for registration, the holder of the registration certificate can independently propose a change in the name of the health function for registration, or can convert the original health function claim when handling other changes, renewal and other applications. For products under review, the review agency will directly adjust the health function claims and relevant content in instructions, and the applicant does not need to make corrections.

2. Transition of Products Whose Health Functions are not Included in the “Function Catalog · Non-nutrient Supplements (2023 Edition)”

      Within 5 years from the date of the announcement, registered products but whose health functions have not yet been included in the “Function Catalog · Non-nutrient Supplements (2023 Edition)” can apply for the corresponding health functions to be included in the health function catalogue according to the “Administrative Measures for Health Food Ingredients Catalog and Health Function Catalog”; or apply to change the health function in accordance with the “Health Food Registration and Filing Management Measures”, abandon the health functions that are not included in the “Function Catalog · Non-nutrient Supplements (2023 Edition)”. At the same time, health functions that comply with requirements of the “Function Catalog · Non-nutrient Supplements (2023 Edition)” should be converted or added.

3. Product Transition with Registration Certificate “Without Validity Period and Product Technical Requirements”

      For products that have been approved for registration and whose registration certificates have “no validity period and no product technical requirements”, the provincial market supervision department shall propose opinions on renewing the product registration certificate based on the technical requirements and supervision situation of the actual production of the product and in accordance with current laws and regulations. The registrant applies to the review agency to convert or add health function claims in the “Function Catalog· Non-nutrient Supplements (2023 Edition)”, and the review agency carries out the review and renewal work in accordance with the “Food Safety Law” and relevant regulations.
